Successful appeal against conviction in Isleworth Crown Court

M was convicted of assaulting an emergency worker, by beating, in Hendon Magistrates Court in November 2020. Following conviction M appealed the decision and his case was heard in Isleworth  Crown Court.

Represented by Katie Spence of the GTS Crown Court team, the defence challenged the complainant and a witnessing officer on the evidence, lawfulness of their stop and search and the reasonableness of the force used on the defendant.

A half time submission was made on both limbs of the Gallbraith test. The application was successful under the second limb after scrutiny of the officers body worn video and the case was stopped at half time with the appeal allowed.
